Tracing the origins of the formation of Malaysia Sept 16

The idea of Malaysia came to fruition in 1963 as a culmination of the combined forces of decolonisation and expanding South-East Asian nationalisms.

THE famous announcement on May 27, 1961 by Tunku Abdul Rahman, then the Prime Minister of the Federation of Malaya, calling for forging closer political and economic cooperation between Malaya, Singapore, North Borneo, Brunei and Sarawak, is generally taken as the starting point for the formation of Malaysia on Sept 16, 1963. The roots of the Malaysia scheme, however, go further back in time and were embedded in British plans hatched in 1942 for the decolonisation of South-East Asia in the post-Second World War period.

In fact, such an idea was first suggested in 1893 by Lord Brassey, director of the British North Borneo Company, who proposed the amalgamation of all British possessions in South-East Asia into “one large colony”. Brassey’s proposal, however, did not find favour with the British Government.

The outbreak of the Second World War and the subsequent capture of all British colonial possessions in South-East Asia by the Japanese changed everything. The British felt humiliated and partly laid the blame for their defeat on the disunited nature of their territorial possessions in South-East Asia which made it difficult to organise a coordinated defence.

In 1942, the Colonial Office led by its Eastern Department headed by G. Edward Gent began to lay plans for a more coordinated post-war policy in South-East Asia. This policy was founded on two principles: preparing dependent territories for the goal of self-rule, and integrating smaller units into larger political blocs.

The justification given for the second objective was administrative efficiency, economic development, political stability and defence viability. Anchoring their policy on these two principles, the Colonial Office laid plans for a “Grand Design” in South-East Asia after the Second World War. This called for the creation of a “union”, a “federation”; a “confederation” or a “dominion” of all British territories in the Malayan-Borneo region.

This large union or federation was to include the Malay states, Straits Settlements, North Borneo, Sarawak and Brunei. This “Grand Design”, which may be appropriately named the “Colonial Malaysia Scheme”, was to be achieved gradually and in stages beginning with political integration in two separate blocs, that is, between Malaya and Singapore on the one hand, and between the Borneo territories on the other.

Confirming this line of action, J. D. Higham of the Colonial Office minuted on Jan 20, 1953 as follows: “Our original idea was that Malaya and Singapore would form one bloc and Sarawak, North Borneo and Brunei, another, and that the two blocs might then merge into some sort of confederation.”

From 1946 to 1949, and even later, the British Government wished to push ahead with the process of integration within the two blocs, but political, strategic and economic exigencies and contingencies on the ground, such as the importance of maintaining Singapore as a naval base, the desire to push the Malayan Union proposals in Malaya, managing the Anti-Cession movement in Sarawak, and the wide gap in the political, economic and social development between the Malayan and Borneo territories, hindered all attempts to bring about any union within these blocs.

Seeing that integration in two separate blocs was not working, the British Government revived the “Grand Design” or the “Colonial Malaysia Scheme” idea in 1949.

Towards this end, the British Government created the post of the British Commissioner-General for South-East Asia to act as a coordinating body in the region. The man chosen for the job was Malcolm MacDonald.

Although he tried very hard, MacDonald achieved little success from 1949 to 1951, however. In 1951, he began to introduce new innovations, the most important being the setting up of branches of the Commonwealth Parliamentary Association (CPA) in the British territories in the Malayan-Borneo region.

By this move, MacDonald was able to foster much regional solidarity and goodwill among the local leaders through the mechanism of CPA meetings. In light of strong support especially from non-officials for a wider regional integration, MacDonald began to push vigorously for the realisation of the “Grand Design” or a British Dominion of South-East Asia in 1952.

Independence and expansion 

But the Commissioner-General’s exuberance was short-lived. By the early months of 1953, support for the Grand Design or Colonial Malaysia began to dissipate mainly as a result of uncompromising attitudes of British colonial officials in Malaya and Singapore. Ongoing animosity between top British administrators of these two states forced the Colonial Office to abandon the idea of forming an overall British Dominion of South-East Asia in favour of the pre-1951 formula of encouraging the formation of separate political blocs.

While the Colonial Office concentrated its efforts in improving relations between Malaya and Singapore, a strong initiative commenced in the Borneo region in 1953 to promote greater administrative coordination between North Borneo, Sarawak and Brunei with a view of their “ultimate federation”.

Political developments in Malaya also began to take fundamental decision-making out of the hands of the colonial masters. The formation of the Alliance Party comprising Umno, MCA and MIC in 1954 and its resounding victory in the 1955 elections to the Federal Council effectively placed Malayan leaders in charge of their destiny.

Under the dynamic leadership of Tunku, Umno and the Alliance, Malaya thus began to move towards independence at a pace far ahead of the British “time-table”. In this context, the views of Tunku and Umno concerning the Malaya-Singapore merger and the wider Colonial Malaysia Scheme became decisive.

Although there grew a strong body of opinion in Singapore in 1954 and 1955 advocating merger with the Federation of Malaya, Tunku and Umno strongly opposed such a union. They feared being outnumbered by the addition of over a million Chinese; that the Malays would lose political dominance; and that Malaya’s security would be seriously threatened. The British, taking stock of the situation, could not countenance merger in the face of Umno’s rejection.

As far as the Colonial Malaysia Scheme was concerned, Tunku in fact lent support to the idea in 1955 and 1956, but the format was to be “Greater Malaya”, which was to be established in the future after Singapore, Sarawak, Brunei and North Borneo had achieved independence.

In 1956, Tunku was more concerned in winning independence for Malaya in a hurry and did not want any scheme of merger or territorial expansion to derail this supreme objective.

“At this stage,” he declared in 1956, “it is wise to be prudent like Kamal Ataturk who resolutely opposed territorial expansion in favour of improving Turkey itself first. Thus, when Malaya achieved independence in 1957 ahead of the colonial “time-table” and ahead of Singapore, the British Grand Design was rendered untenable and therefore remained unfulfilled.

But the idea of Malaysia remained alive both in the minds of the British and Tunku, and finally came to fruition in 1963 as a culmination of the combined forces of decolonisation and expanding South-East Asian nationalisms.

After achieving independence for Malaya in 1957, Tunku Abdul Rahman again broached the subject of forming Malaysia on May 27, 1961. His motivation were, however, slightly different than those of the British. One was to help complete the unfinished British Grand Design of decolonisation, which had been derailed as a result of Malaya’s unexpected independence. When this Grand Design had to be aborted in 1957, Britain began to face an intractable dilemma of finding a workable solution for decolonising the rest of her colonial possessions in the region.

The British found it unfeasible to grant independence separately to Singapore, North Borneo, Sarawak and Brunei as they were too small or too weak politically, economically and in security terms to survive alone. They were also extremely vulnerable to the forces of expanding communism, a situation the British colonial masters wished to avoid for the preservation of their own interests in the region.

In Borneo, the British tried to find a workable solution by fostering the formation of a North Borneo Federation from 1957 to 1960. This attempt failed miserably due to the opposition of the Sultan of Brunei, the rise of Party Rakyat Brunei which wanted to establish Negara Kalimantan Utara linked to Indonesia, and the rising tide of communism in Sarawak spearheaded by the Sarawak Communist Clandestine Organisation.

The Singapore problem became even more alarming with the stark possibility of a communist takeover of the government in 1961.

In these dire circumstances, the British began to look to Malaya and Tunku Abdul Rahman, who was quite ready to do the job for them but had another motive as well for the creation of Malaysia. This second orientation was the desire for territorial expansion, an impulse very much consistent with the phenomenon of expanding nationalisms at the time especially in insular South-East Asia.

Paradoxically, the rise of nationalism in the Philippines, Indonesia, Brunei and the Federation of Malaya also produced a desire among the leaders of these countries for territorial expansion in the region for various reasons.

In the Philippines, the main architect of this nationalist expansion was Diosdado Macapagal who, since the country’s independence in 1946, began to advocate the extension of Philippine jurisdiction on all former Spanish possessions including the Turtle Islands and North Borneo.

Sukarno in Indonesia, wanting to resurrect the Majapahit Empire, laid claim to all former Dutch colonies in the region, including West New Guinea (West Irian) which was not handed over by the Dutch to the Indonesian Republic in 1949. Indonesia also had designs over British Borneo, over which it was casting “covetous eyes” as early as 1953.

Tunku’s Malaysia Scheme also smacked of expansionist aims. He basically wanted North Borneo, Sarawak and Brunei as part of Greater Malaya and was willing to bring in Singapore only if the British Borneo territories were brought in first. In Brunei, Party Rakyat Brunei led by A. M. Azahari was seriously advocating the revival of the former Brunei Empire in the form of Negara Kalimantan Utara from 1956 to 1962.

These expanding nationalisms overlapped in the territorial milieu and produced a period of intense conflict. The concepts of Greater Malaya, Greater Brunei, Greater Indonesia and Greater Philippines were totally irreconcilable and were bound to produce political turmoil in the region.

There was in fact also strong opposition initially from the peoples of British Borneo against Tunku’s Greater Malaya. A great deal of diplomacy and safeguards were necessary to gain their support, and even then Brunei stayed out.

Sabah and Sarawak indeed claim they did not join Malaysia, but formed Malaysia as equal partners with Malaya and Singapore.

Stop paying quit rent to Sultan of Sulu, it’s time to close the chapter

A major shift in Malaysia's position on the Philippine claim to Sabah is needed. 
 
THE Philippines Government officially announced their claim to North Borneo (now Sabah) on June 22, 1962. Despite numerous attempts to settle the issue, it still festers on, exemplified by the latest tragic events unfolding on the east coast of Sabah.

The Philippine claim is based on two documents dated Jan 22, 1878. By the first document, Sultan Muhammad Jamaluladzam granted (pajak) all his territorial possessions in Borneo (tanah besar Pulau Berunai) to Gustavus Baron de Overbeck and Alfred Dent Esquire as representatives of a British Company for a yearly payment/ quit rent (hasil pajakan) of five thousand dollars (Spanish dollars).

By the second document, the said Sultan appointed Overbeck as “Dato' Bendahara and Rajah of Sandakan” with the fullest powers of a “supreme ruler” (penghulu pemerintah atas kerajaan yang tersebut itu).

Descendants of Sultan Muhammad Jamaluladzam (the number cannot be ascertained, but is large), represented by the Kiram Corporation and the Philippine Government, have always claimed that this 1878 grant was a lease (pajakan) and not a cession as claimed by Malaysia. The continuous annual payment of the quit rent or cession monies of five thousand dollars (now RM5,300) to these descendants is cited as further proof of this contention. Based on these grounds, they claim, Sabah belongs to the Philippines/ the Sultan of Sulu's descendants.

Before discussing how Malaysia has been responding to this assertion and how it should alter its position drastically, a little bit of historical narrative is in order.

Without going too far back in time, it is suffice to say historical documents confirm that both the Sultanate of Brunei and the Sultanate of Sulu exercised political control over parts of present-day Sabah (there was no State or Negeri Sabah at that time) in the late 19th century. Brunei had defacto jurisdiction on the west coast from Kimanis to Pandasan, while Sulu ruled the east coast from Marudu to the Sibuku River. The interior was largely independent under local indigenous suku chiefs.

Both Sultanates, however, claimed dejure jurisdiction from the Pandasan on the west coast to the Sibuku River on the east. Both Sultanates were also in a state of decline. Brunei was suffering from internal decay while large parts of its territories were being swallowed up by the new state of Sarawak under the Brookes.

In the Philippine region, the Spanish authorities in Manila had been trying to subjugate the independent and powerful kingdom of Sulu for three centuries without success. In 1871, the Spaniards launched another exerted campaign to conquer the stubborn kingdom.

It was in this kind of environment that a number of European and American speculators became interested in obtaining territorial concessions from the two weak Sultanates for speculative purposes. Among them were Lee Moses and Joseph Torrey of America; and Baron von Overbeck and Alfred Dent who had formed a company called the Overbeck-Dent Association on March 27, 1877 in London for the purpose of obtaining land concessions in Sabah and selling them for a profit.

Overbeck and Dent acquired Brunei's jurisdiction over its Sabah possessions in five documents dated Dec 29, 1877 from the Sultan of Brunei and his ministers. After this, Overbeck sailed to Jolo where he also obtained the rights of the Sultan of Sulu in Sabah through two agreements concluded on Jan 22, 1878.

Why was Sultan Muhammad Jamaluladzan prepared to lease/ grant/ pajak his territories in Sabah to Overbeck and Dent? Sulu was on the brink of capitulating to the Spaniards and as such Sultan Muhammad was hopeful of obtaining some assistance from the Overbeck-Dent Association and possibly even from Britain. Placed in such dire straits, he was therefore not adverse to giving Overbeck and Dent territorial concessions in Sabah with some hope of salvation.

In the event, no such aid came either from the Overbeck-Dent Association or the British Government. Six months after the Overbeck-Dent grants were concluded, Sulu was conquered by the Spanish authorities on July 2 1878. With the fall of Sulu, the said Sultanate ceased to be an independent entity as it was incorporated as part of the Spanish colonial administration of the Philippines.

In 1898, Spain lost the Philippines to the United States by the Peace of Paris (Dec 10, 1898), which ended the Spanish-American War. The US ruled the Philippines till 1946 when independence was granted.

The sultanate ended when Sultan Jamalul Kiram II signed the Carpenter Agreement on March 22, 1915, in which he ceded all political power to the United States.

Meanwhile, in 1936, the US colonial administration of the Philippines abolished the Sulu Sultanate upon the death of Sultan Jamalul Kiram II (1894-1936) in the same year in an attempt to create a unitary State of the Philippines. Jamalul Kiram III is a self- appointed “Sultan” with a dubious legal status.

Now, coming back to the question of Malaysia's ongoing treatment of the claim, and why and how it should completely alter this position. Since the official announcement of the claim by the Philippine Government on June 22, 1962, Malaysia has been pursuing an ambivalent policy. On the one hand, it has persistently rejected the Philippines claim, but on the other it has compromised Malaysia's sovereignty by agreeing to settle the “dispute” by peaceful means (such as the Manila Agreement, Aug 3, 1963) and a number of other mutual agreements between the two countries.

Most damaging of all is Malaysia's willingness to honour the clause in the 1878 Sulu grant pertaining to the payment of the annual quit rent or cession monies as Malaysia says, of RM5,300, to the descendants of the former Sulu Sultanate. To this day, Malaysia is still paying this quit rent, lending credence to the claimants' argument that the 1878 grant was a lease and not a cession and therefore it still belongs to them.

If Malaysia continues to follow this policy, there will be no end to this problem except to buy out the rights of the descendents of the Sultan of Sulu. But this course is fraught with danger as it will lead to further legal complications with the Philippines and even endless litigation with the descendants.

My proposal is that Malaysia should go by the laws of “effectivities”, as in the case of the International Court of Justice's (ICJ) judgement pertaining to the issue of sovereignty over the Sipadan and Ligitan islands, and the law of acts of a'titre de souverain as in the case of Pulau Batu Puteh. No title, however strong, is valid once the original owner fails to exercise acts consistent with the position of a'titre de souverain. The opposite is true, that is, the holder of the lease may not have original title but he ultimately gains permanent possession of the lease by virtue of continuous state “effectivities”.

In this case, the Sultan of Sulu and its successors including the Philippine government have failed to conduct any acts of a'titre de souverain since 1882, and so they have legally lost their title.

On the other hand, the successors of the Overbeck-Dent Association, that is the British North Borneo Company (1882-1946); the British Colonial Administration (1946-1963); and Malaysia, (from 1963) have been exercising continuous acts of a'titre de souverain for a period of 131 years.

Since we have all this evidence on our side, Malaysia should now take a new stand by totally rejecting the validity of the 1878 grants on the grounds of “effectivitie” and a'titre de souverain. It should also immediately stop paying the so-called annual quit rent or cession monies. This payment has always brought huge embarrassment to Malaysia and has in fact compromised its sovereignty.

We should also never agree to go to the International Court of Justice not because our case is weak (it is very strong), but because we don't want to trade the fate of sovereign territories and people through the judgment of any court, even the ICJ.

There's one more point that should be pondered upon. No country or state or nation which has obtained independence has ever paid ownership monies to its former masters. The 13 Colonies of America did not do so, India did not do so, the Federation of Malaya did not do so.

Sabah became an independent state on Aug 31, 1963 and decided to form the Federation of Malaysia with three other partners on Sept 16, 1963. It is strange indeed, if not preposterous, that a sovereign state is paying ownership or cession monies to certain people based on a colonial, pre-independence treaty that is 131 years old!

The Sultan of Sulu reclaims eastern Sabah, MNLF among invaders

THE Sultanate of Sulu was a traditional Islamic monarchy of the Tausug people that covered the Philippine provinces of Basilan, Palawan, Sulu and Tawi-Tawi in the Autonomous Region of Muslim Mindanao (ARMM) and the eastern part of Sabah.

It was founded in 1457 by religious scholar and explorer Sharif Abu Bakar, who assumed the title Sultan Shariful Hashim after his marriage to Paramisuli, a local princess.

He promulgated the first Sulu Code of Laws (Diwan) that were based on the Quran, and introduced an Islamic political institution and the consolidation of Islam as a state religion.

In 1675, the throne of what is now Brunei was disputed and the Sultan of Sulu was asked to settle the conflict, after which he was rewarded with North Borneo (now eastern Sabah).

In 1878, the Sulu Sultan leased North Borneo to the Europeans. The agreement stated that the lease was of their own free will and was valid until the end of time.

The sultanate received an annual cession payment that was equivalent to 5,000 Malayan dollars, which was increased to 5,300 Malayan dollars in 1903.

North Borneo was a British protectorate from the late 19th century until it became a crown colony.

It gained a brief period of independence before becoming part of Malaysia in 1963. From then, Malaysia paid RM5,300 as cession payment each year to the sultanate.

The former Sultan’s descendants did not retake the territory, instead, agreeing to accept the cession payment under the previous arra­ngement. This lasted until a few weeks ago.

The Sulu sultanate was also under the control of Spain, but the Spaniards in 1885 signed the Madrid Protocol with Britain and Germany, relinquishing any claim to North Borneo.

The sultanate ended when Sultan Jamalul Kiram II signed the Carpenter Agreement on March 22, 1915, in which he ceded all political power to the United States.

The Philippines, however, continued to recognise the sultanate as a sovereign entity until the demise of Sultan Mohd Mahakuttah A. Kiram in 1986.

There are now at least 11 claimants to the title Sultan of Sulu, including Sultan Jamalul Kiram III.

MNLF elements among invaders


PETALING JAYA: The Sulu invaders are not officially recognised by any group other than the self-styled Sulu Sultanate and its supporters, said Universiti Pertahanan Nasional Malaysia Professor Dr Aruna Gopinath.

“This is just a name this group has decided to create and call themselves by so that they can come and attack us.

“The bigger threat is if other militants join this group under the banner of the south Philippines and try to attack us as well,” said Aruna, an expert on Philippine history, politics and security.

Some of the Sulu fighters were possibly trained by the Moro National Liberation Front (MNLF) led by Nur Misuari before they broke away from the group.

She explained that many of the armed militants in southern Philippines used to be members of the MNLF, from which many breakaway groups later emerged with most of them belonging to the Suluk or Tausug ethnic group, which the MNLF once represented.

“Some among the so-called Sulu army could have had combat experience during their previous stint in the MNLF before they broke away. They do have some degree of skill and are not mere marauders as there appears to be some quite capable people on the ground,” said Aruna.

She said that when Misuari became MNLF head he clamoured for secession but the Philippine Government insisted on autonomy as the only option.

Hong Kong 15th aniversary on return to China

Hong Kong SAR chief executive-elect Leung Chun-ying takes over the reins of government tomorrow and throws a challenge to the city to really call China its home.



TOMORROW, the people of Hong Kong and the mainland Chinese will celebrate the 15th anniversary of the return of Hong Kong to China.

Days ahead of the momentous celebration that will be attended by Chinese President Hu Jintao and featuring fireworks, military parade and parachute jumps, Hong Kong Special Administrative Region (HKSAR) chief executive-elect Leung Chun-ying threw a challenge to the city to really call China its home.



During an interview with the Chinese media late last month, Leung said that since the handover in 1997, the city dwellers had developed a sense of belonging with their motherland but it would take a little longer before remnants of the British influence disappear entirely.

“There are two meanings of the handover. First, Hong Kong was legally returned to China and the Chinese government retained the administrative power of Hong Kong by establishing the HKSAR and passing the Basic Law for the ‘one country, two systems’ and ‘Hong Kong run by Hong Kong people’ model,” the People’s Daily quoted Leung.

“On the other hand, Hong Kong was under British control for 100 years. More needs to be done to rid that influence on people.”

For instance, he said, some Hong Kong people would still say that they were “leaving for China” instead of “going to the mainland”.

He cited an example where a Hong Kong saleswoman told her friend on the mainland that she had visited Beijing on her friend’s National Day, instead of referring to the celebration as hers, too.

“These people may not have any political stance when they speak that way. This is probably due to decades of British rule. We will keep on educating our people so that they can better understand the country. But we cannot rush it; it has to be done step by step,” he said.

Leung will begin his tenure as the new boss of the city for a five-year term starting tomorrow, along with his government line-up of Carrie Lam Cheng Yuet-ngor, John Tsang and 18 others.

Besides working on better interaction between Hong Kong and mainland Chinese people, the new HKSAR government has to tackle social problems such as the influx of mainlanders which puts a strain on the city’s healthcare and housing resources.

On the economy, Hong Kong will have to work around the central government’s supporting policies to maintain its competitiveness and improve its people’s livelihood.

In its editorial, the Hong Kong-based Sing Pao daily said the people of Hong Kong had mixed emotions and experienced ups and downs in the last 15 years, but the city was heading in the right direction under the “one country, two systems” policy.

“It was unavoidable that we had to ‘cross the river by touching the stones’. In the past 15 years, we have seen numerous conflict of opinions, political hostility and delayed reforms. No matter how many protests and demonstrations were staged, the majority of residents remain united in steering this boat named Hong Kong forward,” it said.

Oriental Daily hoped that Leung would “clean up the mess” left behind by his predecessors Tung Chee-hwa and Donald Tsang, and, turn around the economy and stabilise the social situation.

“During elections, Leung Chun-ying pledged to introduce a financial development unit if he was elected. Now he has walked the talk by setting up a committee headed by executive council member Laura M. Cha to form the objectives, functions and operations of the unit.

“Leung should invite financial advisers and economics experts to give their input on how to solidify Hong Kong’s status as the world financial centre and to counter future financial crises. Let us see if the Leung administration can lead Hong Kong on a new path of development,” the newspaper said.

Recently, Beijing announced a package of supporting policies such as issuing bourse-traded funds listed on both the Hong Kong and mainland stock markets, encouraging foreign investors to use the yuan for trade settlement in the city and easing restrictions on small businesses run by Hong Kong residents in the mainland.

Peng Qinghua, director of the liaison office of the central government in HKSAR, told China Daily that Beijing had played a key role in maintaining Hong Kong’s prosperity by keeping its promise of autonomy for the HKSAR government.

“The economic achievement in Hong Kong today is the result of its people’s ability to take the opportunities, and their flexibility and diligence. However, it could not have happened without the support of its motherland,” he said.

Peng hoped that the people from both sides would continue to respect their differences, improve communications and deepen cooperation in order to achieve real unity.

The People's Liberation Army troops had been at the garrison for a month, following the return of Hong Kong to China on July 1, 1997, and many residents expected them to have a high-profile presence.

"I told the official that the reason we were invisible was because we only leave the base when necessary, to not disturb residents," Zhang said ahead of the 15th anniversary of the handover.

This is a policy that stayed unchanged for 15 years.

The garrison, which has roughly 8,000 troops spread over battalions of infantry, engineers, airborne staff and navy personnel, is housed in several bases across the special administrative region.

Due to some differences between the mainland and Hong Kong, which the United Kingdom controlled for more than a century, and the "one country, two systems" policy, PLA troops stationed adhere to stricter rules than those in other parts of China.

"We have to be committed to strict discipline to gain the trust of Hong Kong citizens," said Zhang, who heads the garrison's infantry division.

Liang Yuejia, deputy director of the garrison's political department, explained that there was a lot of suspicion among residents at first that soldiers would get involved in local affairs, such as reacting to street protests.

"But we didn't. Unless the protesters illegally entered our barracks or threatened our lives, we did not resort to contacting the police," he said, adding that they respected such activities according to local regulations.

Even when anti-communist literature was thrown over the walls or staff received harassing calls from political groups, officials said they did not react.

That policy of noninterference has over the years helped the garrison gain a good image among residents.

A poll of 1,006 people by the University of Hong Kong last year found that only about 2 percent of those polled had a negative opinion about the garrison.

"Developing a good relationship with citizens has been the key," said Lieutenant General Zhang Shibo, commander of the garrison. "I think that mission has been accomplished."

Major Wu Qiong, a battalion commander with the garrison's communication station, added: "Before 2000, Hong Kong citizens usually kept their distance. But after years of interaction, many now often say hello. I guess that's because they are aware of our decent style of working and strict discipline."

Increasing openness

Compared with the "invisibility" of the early years, the garrison has greatly increased its openness to the outside world in recent years.

Besides regular training and exercises for army personnel, officials have also been promoting links between Hong Kong and the mainland through various activities, said Lieutenant General Zhang Shibo.

The troops have actively participated in public activities, such as planting more than 50,000 trees, donating 2.5 million milliliters of blood and helping more than 2,600 elderly people and children in care homes.

The garrison has also opened its barracks 23 times to visitors, receiving around 469,000 local people, and held summer camps for children.

The last open day, on May 1, attracted 37,000 visitors, far more than the 28,000 expected and extra free admission tickets had to be distributed. Some people waited in line overnight to get a ticket.

During the open days, guests can view the military facilities and watch soldiers perform combat skills and motorcycling stunts, including drills by the first female special forces of the PLA army.

"One of the reasons why we are gaining increasing recognition in Hong Kong is that the openness of the barracks provides local people with an opportunity to know more about us, as well as a platform for us to serve them," said Lieutenant General Wang Zengbo, political commissar of the garrison.

The activities organized by the garrison also present the PLA, the Communist Party of China and the mainland to Hong Kong residents in a proper way, Wang said. "Their national identity and patriotism have greatly increased," he said.

The garrison has organized seven military summer camps for around 1,200 local teenagers, six exchange activities with 1,600 students from 12 local universities and a military camp for college students. The troops also visited the University of Hong Kong for the first time in 2011 and talked with students.
A total of 215 teenagers participated in the military summer camp in 2011, and the number is expected to reach 260 this year.

"Despite the increase, every school can only send one student, while dozens of others actually want to come, so we'll continue enlarging the camp's scale in future," said Wang.

Tung Chee-hwa, former chief executive of Hong Kong, said the camps influence many families and hundreds of people even though there are only about 200 participants every year, and they also would influence the participants' whole life even they only last for 15 days. 
In 2010, Hong Kong saw an upsurge of young people wanting to enlist in the military. Most of the 4,000 local young people who signed up for enlisting participated in the garrison's exchange activities and military camps.

The summaries written by military camp participants revealed that the 15-day interaction with the garrison provided them with a chance to learn more about the troops, socialism, the Communist Party of China, as well as the strength of the PLA and China, Wang said.

Boosting defenses
With the garrison enjoying a good image in Hong Kong, Zhang Shibo said the focus has shifted from public relations to bolstering military defense.

The mission of the garrison is mainly to exercise China's sovereignty over Hong Kong, safeguard social stability and provide disaster relief and defense campaigns. However, military training is also a priority.

"Since 2007, we have invested millions to upgrade our army's equipment, navy and air force," said the garrison's commander.

Based on Hong Kong's strategic features, the PLA garrison added a special forces unit, an armored battalion and a chemical defense battalion. It has also been equipped with reconnaissance planes, armed helicopters and air defense missiles.

"We aim to test our basic military strength, commanding and organizing capabilities through joint drills," Zhang Shibo said.

The infantry brigade, the garrison's pillar force, has ranked at the top for three years in the military competitions in the adjacent PLA Guangzhou Military Area Command, which has the administrative control of the garrison.

Speaking of the possible challenges the garrison faces, Brigadier Zhang Jie said the garrison "needs to be prepared to tackle possible regional conflicts at all times".

Batang Kali massacre: British soldiers admitted unlawful killings

Scots Guards soldiers admitted unlawfully shooting dead 24 Malaysian villagers then covering up the massacre, the high court has been told.

Calling for an official inquiry into the mass killing during anti-insurgency operations in 1948, lawyers for relatives of the victims disclosed for the first time the soldiers' accounts given during police interviews.
The statements were taken in 1970, when the then Labour government ordered an investigation into the deaths.

Six of the eight soldiers interviewed under caution by detectives corroborated accounts that the villagers had been unlawfully killed, Michael Fordham QC, counsel for the Malaysian relatives, told the court.

One member of the Scots Guards platoon, Alan Tuppen, maintained that a sergeant had said beforehand: "The (villagers) were going to be shot and we could fall in or fall out."

William Cootes, another soldier, told detectives he saw as another sergeant "motioned to (a) youth to run and then he shot him".

George Kydd, also a member of the Scots Guards patrol, recalled in 1970 that: "The bandits were then shot but I'm sorry I must tell you the truth, they were not running away.

"There was an inquiry later on and I've got to go along with this, we were told before going in to tell the same story, that is that the bandits were running away when they were shot … I don't remember who told us to tell this story but it was a member of the army."

The police investigation was launched after a newspaper carried some of the soldiers' accounts of what had happened 22 years earlier.

The probe was abruptly cancelled, however, in June 1970 after the Conservatives won the general election.

An internal police report by Detective Chief Superintendent Frank Williams, who led the police investigation, contradicted official explanations that there was insufficient evidence.

His report, disclosed to the high court, said: "At the outset this matter was politically flavoured and it is patently clear that the decision to terminate enquiries in the middle of the investigation was due to a political change of view when the new Conservative government came into office after the general election."

Relatives of those killed in Batang Kali, who have twice petitioned the Queen, are challenging the government's continued refusal to hold an inquiry into the incident.

Judicial review of the decision will continue until Wednesday.

Judgment is expected to be reserved.

The Ministry of Defence and Foreign Office maintain that it is too late for lessons to be learned from any inquiry and that most of the witnesses are no longer alive.

NOTHING can shatter one’s world as much as the brutal murder of a loved one. The tragic account of beheaded headman Lim Tian Swee is one that still remains fresh in the memory of son Lim Kok – even 64 years after the horrific massacre that took place on Dec 21, 1948, in Batang Kali, Selangor.



Lim Kok was about nine years old when he received news from other villagers that his father had been decapitated and his head thrown into the river.

“My father was working as headman of a rubber tapping estate – which was managed by a distant granduncle – who paid salaries to the workers and looked after their welfare,” says Lim, 73. “He was my family’s sole breadwinner. Life became tough for us all after father was gone. My mother had to seek the help of friends and relatives to raise the rest of us. I was sad, yet I was also too little to understand any fear that came from the implications of my father’s killing.”

After the murder, Lim, who is the eldest of he children, went to stay with the granduncle in Kuala Lumpur where he studied. His mother, however, stayed behind in Ulu Yam Baru to look after her other children. The granduncle helped subsidise Lim’s living expenses and studies and the boy would return on and off to Ulu Yam Baru to see his mother and siblings.

“Thanks to some funds and assistance from this granduncle too, we managed to provide my father with a proper burial according to Buddhist rites ... even if the head could not be traced.”

Lim returns to the burial ground every year to offer prayers to his father during Qing Ming (a festival during which people pay respect to their ancestors).

He is one of four descendants who left Malaysia for London to attend today’s judicial review test case to hear a proper investigation into the massacre by British soldiers of 24 unarmed villagers at Batang Kali in 1948.

Wong Then Loy was just a child when he helped his father collect the victims’ bodies for burial.

“My only wish is for the trial to grant us sufficient compensation and a proper apology for the misdeed that was unleashed against the 24 people.

“Coming back to Batang Kali is a grim reminder of the suffering and misery that we had to endure and the poverty that my siblings, especially, had to grow up with – after all these decades, we are hopeful that fairness and justice will prevail,” he said before leaving for London.

Ulu Yam Baru village headman cum the Action Committee Condemning the Batang Kali Massacre chairman Chin Fo Sang recalls listening to stories of how the villagers were rounded up and divided into five different groups before being executed. “After they were all killed, some of the bodies were left by the riverside and others placed in groups inside plantations.”

Chin, 64, was only about two months old when the episode unfolded back in December 1948. Many of the tales were related to him by his parents, relatives and villagers much later.

The clear gentle waters of the river into which Lim’s father’s severed head was thrown belie the horror swept away by torrents of time. The head, says Chin, was washed down to a Malay village where it was discovered by horrified local women. “They threw it back into the river and it was never seen again. This is why till today, Lim’s father is without a head,” says Chin.

Chin leads us back a short distance away where a single wooden house stands amidst thick foliage and shrubs mixed with a few banana trees. “This is the site where the first victim, Luo Wei-Nan, was executed. The story goes that the soldiers herded him here before shooting him in the back. The bullet penetrated through the body and left such a gaping puncture that his internal organs all spilled out,” Chin says softly, the horror still clear in his voice.

Chong Koon Ying was 11 when her father Chong Man was shot. “We heard a lot of gunshots – the booming noise they made – but we were not allowed to see what happened. I could see thick smoke billowing about right after, though.

“Later, a lorry whisked all the women and children away and we were not allowed to even go back to our houses to collect any of our clothes or belongings.

“We were left homeless overnight after our village was set ablaze. Some people who saw us seated aimlessly on the streets (in the nearby town they had been taken to) took pity on us and found us a decrepit house for shelter.

“Because there were so many families cramped into one small space, the children had to sleep on the floor while my mother slept seated on a stool.”

Choking with emotion, Chong says she was married off at 16 while her siblings had to be given away for adoption as her family had nothing to survive on.

“We had to be split up when food and everything else became scarce,” says Chong, now 73. “I tried finding my sister but to no avail. And when I found my brother, he was badly beaten up. I could never forget how my heartbroken mum died when she found out.”

Chong who is now living in KL, having shifted after her marriage, says her children and grandchildren have been told of this savage murder that tore families apart and left traumatised women and children incapacitated.

“What else can I ask for now except for cash compensation. My parents are gone; at the very least, monies should be paid for the hardships and our pain, although no amount can bring them back.”

There is an interesting story surrounding the last surviving witness to the massacre, Tham Yong, who died in 2010. Her fiance was one of the 24 shot dead while his brother was the victim who fainted and happened to survive the massacre. Tham Yong later married him and son Chong Nyok Keyu is now taking up the fight following her passing.

Another witness is Wong Then Loy who was just eight when he helped his dad to collect the corpses, a week after the massacre.

“The bodies had rotted, some had dried up; some even had huge maggots crawling out,” recalls Wong, 73. “As a kid, I wasn’t afraid of seeing the worms since I was used to following my father deep inside the jungle before we were chased out to stay in the new villages.

“Of course, I also didn’t know exactly what had happened except that they were dead bodies. My father related to me the stories later while I also gathered bits of excerpts from wives of the deceased and some neighbours.”

His father helped to engrave names on the tomb stones after the dead had been identified by their relatives. Some remained unidentified and unclaimed so they were buried together in one plot – Wong recalls some of these were young men, barely 20.

“The poorer families could not afford coffins so their loved ones were buried without any, while some others made the funerary box by nailing planks together,” he remembers.

The original victims are long gone, but the voices of these departed souls have certainly not been silenced. Their next-of-kin are determined to secure justice for this massacre that took place in the jungle a whole lifetime ago.

Representing them are four claimants at today’s judicial review application in London: Chong Nyok Keyu, Loh Ah Choi (nephew to the first victim to be shot, Luo Wei-Nan), Lim Kok, and Wooi Kum Thai.

More than 60 years after British troops killed 24 villagers at Batang Kali, Selangor, the case against the soldiers is going to be heard in the British courts today. 

IN 1948, the Malayan Emergency was just heating up. The country may have been weary of four brutal years of Japanese occupation during World War II, but the brief post-War dominance of the Communist Party of Malaya (CPM) was clearly at odds with the desire of the British authorities to reclaim a territory whose raw materials would help rebuild Britain itself.

By 1948, this had erupted into an undeclared war that would be waged until 1960. British forces sought to subdue the Communists, who had gained a degree of popularity for their resistance towards the Japanese. It didn’t help that in China, Mao’s Communist Party was on the verge of defeating the Kuomintang nationalist party.

It was against this backdrop that the 7th Platoon of G Company, of the second battalion of Scots Guards unit of the British Army, belied its centuries-long reputation for honour. On Dec 12, 1948, under the leadership of Sgt Charles Douglas, the Guards surrounded a rubber estate near Batang Kali, Selangor. Looking for Communist guerillas who habitually moved in and out of the local population, they shot and killed 24 ethnic Chinese villagers before razing the village.

The next day, The Straits Times carried a report stating “Scots Guards and Police were today reported to have shot dead 25 out of 26 bandits during a wide-scale operation in North Selangor.” It called the killings the “biggest success as yet achieved in one operation in Malaya since the Emergency began.”

It was a bold-faced lie. The troops may have been acting on false information or may have panicked but there is little doubt that many innocent people were killed. Worse still, the incident was hushed up, only surviving as whispers through time.

There were, however, some survivors. One man fainted and was presumed dead, while some women and children of the men killed lived to tell the tale. According to them the Scots Guards had separated the men to be interrogated before the situation turned into a rampage of indiscriminate shooting.

“At the time we didn’t hear much,” recalls Prof Emeritus Tan Sri Dr Khoo Kay Kim. “We just heard some rumours. I would not call it the norm, but no doubt there was tension. What happened at Batang Kali was part of the complexity of society which can lead to such tragic situations. It is almost unavoidable in times of conflict and when there is hatred between ethnic and territorial groups. I see it as a conflict of cultures.

“From what I understand, they were innocent men. But the Chinese may well have reacted in a peculiar way that would have seemed suspicious to the British, who were paranoid and ignorant of local ways. The British always had problems with the Chinese community.

“That is why Governor Sir Shenton Thomas tried to come up with a programme to Anglicise the Chinese, but they were not easily controlled. At that point (in 1948) the Chinese were under the influence of the leftists and the secret societies. They were themselves enemies and in some ways it mirrored the conflict in China between the Kuomintang and the Communist Party.”

Prof Datuk Dr Shamsul Amri Baharuddin laments the tragic loss of life. “At the time the British would have had their own people on the ground. But informers can make the biggest mistakes, sometimes even on purpose. It is possible that the informer didn’t like these people. In this case, it is likely that the British acted on wrong information.

“It is difficult to be an informer/undercover agent because both sides will crucify you. In fact in the 1940s, the leader of the Communists, Loi Tak, was a triple agent, a Vietnamese who worked for the Japanese and the British while leading the CPM!

“The conditions of war generates different dynamics, which we can still see today in Afghanistan and Iraq where there are many vendetta killings and economic killings done under falsified circumstances.”

Leon Comber played a critical role in the formative years of the Malaysian police force’s Special Branch and spent many years countering the Communist insurgency. The author of Malaya’s Secret Police, 1945-1960: The Role Of The Special Branch In The Malayan Emergency has no light to shed on the Batang Kali incident but does concede that, at the time, there was much mistrust between the Chinese community and the British.

Comber had come over to Malaya as part of the re-occupying forces that took over as the Japanese surrendered. In 1946 he was appointed to the police force in Malaya. He served as OCPD (Officer in Charge of Police District) KL South; at that time KL was divided into north and south zones for policing.

The Emergency was a savage war in which an estimated 12,000 people died. Did Comber ever have to do anything he was ashamed of?

“Personally I didn’t, nor did I order any men under my command to do so. But I certainly heard rumours about dubious interrogation techniques. Apparently the head of the Special Branch, Richard Craig, issued a pamphlet which referred to undesirable methods of obtaining information. I was taken aback when I heard that. But if my fellow colleagues knew anything, they kept it to themselves.”

Indeed, secrecy was very much the order of the day as the colonial government maintained strict control over the media to ensure that only their viewpoint got through to the people. Little was known at the time of the Malayan Emergency’s many flash points like the standoff in Bukit Kepong, Johor, on Feb 23, 1950, between police officers and Communist guerillas that ended with more than 20 fatalities on each side. Across the pond, on Dec 3, 1949, the British governor of Sarawak, Sir Duncan Stewart, was stabbed to death by teenage Malay nationalist Rosli Dhobi.

A few years after the Batang Kali massacre, the Briggs Plan was put in place to win the hearts and minds of the local population. Devised by General Sir Harold Briggs shortly after his appointment in 1950 as the Emergency’s director of operations, the plan comprised the forced resettlement of rural Chinese population into “New Villages” where education, health services and homes with water and electricity were provided. Even as the Emergency continued and news remained tightly controlled, the Batang Kali massacre reared its ugly head from time to time. Soon after the incident, in 1949, an investigation by the Attorney General, Sir Stafford Foster-Sutton, concluded that the villagers would have escaped with their lives if not for the soldiers opening fire – yet, no action was taken.

In fact, only the soldiers themselves were questioned as witnesses; no villager was asked for testimony. The cover-up echoed that of another British colonial massacre in Amritsar, India, in 1919 when Colonel Reginald Dyer ordered the shooting deaths of hundreds of unarmed Indian civilians.

Following the My Lai massacre in the late 1960s during the Vietnam War, when US troops unable to distinguish friend from foe slaughtered all the villagers in My Lai, the Batang Kali incident was revisited by British newspaper The People. Then British Secretary of State for Defence (from 1964 to 1970) Denis Healey set up a team to investigate the incident. But the case was soon dropped for “lack of evidence”, despite statements made from former members of the patrol that made it clear they had been ordered to lie about the killings during the 1949 investigation.

Still later, in 1992, In Cold Blood, a BBC documentary was aired about the killings, making it obvious that a travesty had occurred, not just with the killings but with the cover-up that followed. Journalists Ian Ward and Norma Miraflor also painstakingly put together Slaughter And Deception At Batang Kali (Media Masters, 2009), another work that endorses this viewpoint.

MCA Public Services and Complaints Department head Datuk Seri Michael Chong became involved with the case during the filming of In Cold Blood.

“It is not only me who is fighting this case,” he says. “Over the years many fought it. Even (Malaysia’s first Prime Minister) Tunku Abdul Rahman fought it before independence. But when I came to it in 1992 it had been forgotten. All the time there had been a ding-dong and finally after a change of government in the UK, the case was closed.

“In late 1992, a group of BBC journalists came down with a few ex-Scot Guards who were all in their 70s or 80s. They were not involved in the massacre but had been asked by their Commanding Officer to help with the post-massacre clean-up. They came and asked the villagers to remove the bodies. After so many years they felt bad.”

Chong was outraged by the injustice and decided to act. “Along with the lawyers Vincent Lim and Datuk Lim Choon Kin, I took an interest. We went to see the place and met the survivors. In 1993 we called a press conference and, with the victims’ descendants, we lodged a police report in Batang Kali.

“After that, we drafted a letter to Her Majesty the Queen to investigate this old case and seek for justice. We went to see the then High Commissioner, H.C. White, and were given assurances that the letter would be passed to her. Meanwhile, we also worked with the police. I was cautioned by the Malaysian police not to stir up this sentiment.

“To be very frank, some leaders also asked me why I wanted to bring up this old matter. They neither supported me or were against me at first. But later on they gave me their moral support.

“For me, this has never been about the publicity. I just want justice for the victims. I want the British Government to recognise and admit that such an incident happened. They were all shot in the back of the head from a close distance. This is cold-blooded murder. They were never Communists, but simple rubber-tappers. They were not even sympathisers.”

Eventually, through the perseverance of people like Chong, the British Government relented and agreed to hear the case.

Lawyer Quek Ngee Meng is part of a new generation of Malaysians who feel that there is no statute of limitations on justice.

“Back in 2004 my father, the late Quek Cheng Taik, used to visit the hot springs in Ulu Yam near Batang Kali to treat an illness. He used to go from Serdang to that area and eventually bought a house in Ulu Yam. He listened to the stories of villagers.

“It is still a talked-about topic there more than 60 years on. Those killed were from Ulu Yam. If you go there you won’t miss the cemetery. Every Qing Ming (a day to pay respect to one’s ancestors) they go back.

“They still feel it. It is still a stigma. The official account says they were suspected of being bandits. When we followed the case, we found a lot of cover-ups.”

But what can be accomplished after so many years?

“I think the first thing is an admission and an apology” says Quek. “The victim’s families also lost their bread-winners so we are also seeking compensation.

“Over here there are still about five witnesses to what happened. In Britain some soldiers are still alive. I think there are more than 10 on the British side. There are many who have passed away in Malaysia, most recently Tham Yong in 2010. But we documented their testimony.

“When pursuing this case, the famous human rights law firm Bindmans backed us and were willing to procure legal aid. Before they (the United Kingdom Legal Service Commission) granted us that aid, though, they checked that we needed the funds. They also checked if there was any merit in the case. Their estimate is a 50% to 60% chance,” says Quek.

Today and tomorrow, the team in London will be applying for a judicial review to quash the earlier decision by the British Government not to investigate the tragedy.

Quek says incidents like Batang Kali were not necessarily unique at the time. “There are many other cases of injustice during the Emergency. You must understand, this was at a time when the British thought all Chinese were Communists. The Chinese had to prove they were not Communists.

“But even in such circumstances you must follow the rule of law. If they are identified by informers they should have been detained and questioned. But they were not.”

Quek makes a final point about the upcoming trial. “We made a lot of progress with the (British) Labour Government, but since the Conservative-led coalition took power, they have not been so straightforward with us.

“They have made a lot of representations using technical points trying to claim that it was the Selangor Government who had jurisdiction and we should take action against the Sultan instead of them!

He adds that, “This is a landmark case with an individual suing the British Government, and I am looking forward to the trial.”

It remains to be seen if justice will indeed finally be served.

The judicial review test case on the alleged brutal killings of the unarmed rubber tappers by British soldiers has been fixed for Tuesday and Wednesday.

Action Committee Condemning the Batang Kali Massacre adviser and founder Tan Hai Kee said the hearing would be fully funded by British taxpayers.

“It will be a significant breakthrough for Malaysian civilians and NGOs in challenging the British Government's decision.

“We want the British government to clear the names of the families, as the tappers were branded as bandits and communist insurgents,” he said after a briefing and prayer ceremony at the Kuala Lumpur and Selangor Chinese Assembly Hall yesterday.

On Dec 12, 1948, about a dozen elite Scots Guards went into a village in Batang Kali and separated women and children from the men. They then allegedly executed all but one of the men who pretended to be dead.

Some of the bodies were later decapitated and their genitals smashed. The Guardsmen claimed the victims were armed and tried to escape but the committee countered that this was a cover-up.

The committee submitted a petition to the British government twice, first in March 2008 via the High Commission and another in November 2010 addressed to Queen Elizabeth II.

The first petition sought an apology and compensation of £80mil (RM393mil) but Tan said monetary gain was not the main issue.
